Welcome to Probable Pitcher! These Terms of Service ("Terms") govern your access to and use of our iOS and Android mobile applications and our website located at https://probablepitcher.com (collectively, the "Service"). The Service is operated by Probable Pitcher ("we," "us," or "our").

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

Probable Pitcher provides data, analysis, and information related to baseball pitchers and games (the "Information"). The Service is provided for informational and entertainment purposes only. We are not a gambling service and do not accept or place wagers of any kind.

You may stop using the Service at any time. We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for any conduct that we believe violates these Terms or is otherwise harmful to us, other users, or third parties.

7. Disclaimers and No Warranties

This is important, so we'll be blunt. The name is Probable Pitcher, not Guaranteed Pitcher. The Information provided is based on data and statistical models that are subject to error and change.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE. YOUR USE OF THE SERVICE AND ANY RELIANCE ON THE INFORMATION IS ENTIRELY AT YOUR OWN RISK.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PROBABLE PITCHER, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, OR AGENTS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE.

THIS INCLUDES ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, LOSS OF REVENUE, LOSS OF PROFITS, OR LOSS OF DATA, WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS OR ONE HUNDRED DOLLARS ($100).

9. Indemnification

You agree to defend, indemnify, and hold harmless Probable Pitcher and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

10. Governing Law and Dispute Resolution
